In Moldova, enterprises with foreign capital can only be registered under two forms of ownership: JSC (Joint-Stock Company) and LLC (Limited Liability Company). The tariffs, requirements, and rights of foreign citizens and non-residents when registering an enterprise are in no way different from the tariffs, requirements, and rights of Moldovan citizens.

We recently found information in the press. Some foreign businessmen use companies in Moldova as offshore companies. They register a firm, open a current account, conduct virtually no activity on the territory of Moldova, and submit zero reports. They only conduct activities abroad and receive transfers to foreign currency accounts. Isn’t that a Moldovan offshore?

Since January 1, 2012, in Moldova, only lawyers can represent the interests of citizens in court (civil cases and criminal cases). Many lawyers complain that because of this, they have lost more than they have gained. Since it was possible to additionally hire legal advisors and take on many civil cases to protect the interests of citizens. As a result, the new law satisfies neither the legal advisors nor the lawyers of Moldova.

The “Guillotine Rule” is in effect in Moldova. Anything not published in the “Official Monitor” publication has no force at the legislative level. All imaginary directives and instructions coming from willful officials and not published in the “Official Monitor” are not binding. And they may not be complied with.

Many citizens distort the name of the certificate “Certificate of No Criminal Record.” For example, “Certificate of Criminal Record,” “Certificate of Non-Conviction,” “Certificate that there was no criminal record.” Also, most citizens do not fully understand the meaning of the word “non-conviction.” Non-conviction does not mean that the person was previously not convicted. They could have been convicted but had the conviction expunged, for example, by serving the sentence. If a person has thus expunged the conviction, they are considered not convicted today. If the conviction has not been expunged, they will simply not be issued a certificate of no criminal record.
